A BILL
To amend the Farm Security and Rural Investment Act of 2002 to enhance
the ability of oilseed producers to use oilseed base acres for the production
of fruits and vegetables.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Farming Flexibility Act of 2003'.
SEC. 2. PRODUCTION OF FRUITS AND VEGETABLES FOR PROCESSING ON OILSEED BASE
ACRES.
(a) EFFECT ON OILSEED BASE ACRES CALCULATION- Section 1101 of the Farm Security
and Rural Investment Act of 2002 (7 U.S.C. 7911) is amended by adding at the
end the following new subsection:
`(i) CALCULATION OF OILSEED BASE ACRES- Effective on the date of the enactment
of this subsection, the planting, prevented planting, or production of fruits
or vegetables for processing shall be deemed to be the same as the planting,
prevented planting, or production of oilseeds for purposes of the calculation
of oilseed base acres.'.
(b) PLANTING FLEXIBILITY- Section 1106 of such Act (7 U.S.C. 7916) is amended
by adding at the end the following new subsection:
`(e) PRODUCTION OF FRUITS AND VEGETABLES FOR PROCESSING- Effective on the
date of the enactment of this subsection, a fruit or vegetable for processing
may be produced on oilseed base acres, except that direct payments and counter-cyclical
payments for oilseeds shall be reduced by an acre for each acre planted to
the fruit or vegetable.'.
