To amend title 10, United States Code, to provide that military retired
pay for nonregular service shall be paid without regard to the age of a person
otherwise eligible for such retired pay, rather than commencing when an otherwise
eligible person attains age 60.

A BILL
To amend title 10, United States Code, to provide that military retired
pay for nonregular service shall be paid without regard to the age of a person
otherwise eligible for such retired pay, rather than commencing when an otherwise
eligible person attains age 60.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Armed Forces Retirement Equity Act'.
SEC. 2. IMMEDIATE RECEIPT OF MILITARY RETIRED PAY FOR NONREGULAR SERVICE.
(a) REPEAL OF RECEIPT AT AGE 60- Section 12731(a)(1) of title 10, United States
Code, is amended--
(1) by striking paragraph (1); and
(2) by redesignating paragraphs (2) through (4) as paragraphs (1) thru (3),
respectively.
(b) EFFECTIVE DATE- The amendments made by subsection (a) shall take effect
on the first day of the first month beginning after the date of the enactment
of this Act and shall apply with respect to retired pay payable for that month
and subsequent months.
