MARIO DIAZ-BALART of Florida, Mr. SHAW, Ms. GINNY BROWN-WAITE of Florida,
Mr. CULBERSON, Mr. PEARCE, Mr. KING of Iowa, Mr. MANZULLO, Mr. MCCOTTER, Mr.
SMITH of Texas, and Mr. PUTNAM) introduced the following bill; which was referred
to the Committee on the Judiciary, and in addition to the Committee on Transportation
and Infrastructure, for a period to be subsequently determined by the Speaker,
in each case for consideration of such provisions as fall within the jurisdiction
of the committee concerned
A BILL
To amend title 18, United States Code, and other laws to protect
children from criminal recidivists, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as `Carlie's Law'.
SEC. 2. REVOCATION OF PROBATION OR SUPERVISED RELEASE.
(a) Probation- Section 3565(b) of title 18, United States Code, is amended--
(1) by striking `or' at the end of paragraph (3); and
(2) by inserting after paragraph (4) the following:
`(5) commits a felony crime of violence; or
`(6) commits a crime of violence against, or an offense that consists of
or is intended to facilitate unlawful sexual contact (as defined in section
2246) with, a person who has not attained the age of 16 years;'.
(b) Supervised Release- Section 3583(g) of title 18, United States Code, is
amended--
(1) by striking `or' at the end of paragraph (3); and
(2) by inserting after paragraph (4) the following:
`(5) commits a felony crime of violence; or
`(6) commits a crime of violence against, or an offense that consists of
or is intended to facilitate unlawful sexual contact (as defined in section
2246) with, a person who has not attained the age of 16 years;'.
SEC. 3. AMBER ALERT GRANT PROGRAM.
(a) Eligibility Requirements- Section 303(c) of the PROTECT Act (42 U.S.C.
5791b(c)) is amended by adding at the end the following:
`(3) Additional eligibility requirement- To be eligible for a grant under
this section in a fiscal year, a State shall certify in writing to the Secretary
that, in the fiscal year, the State, with respect to a minor residing in
the State, will make a good faith effort to notify any non-custodial parent
of the minor if--
`(A) the minor is the victim of a crime of violence or sexual abuse; or
`(B) the custodial parent of the minor is charged with a drug offense,
rape, or crime of violence or sexual abuse.'.
(b) Authorization of Appropriations- Section 303(h) of such Act (42 U.S.C.
5791b(h)) is amended by striking `fiscal year 2004' and inserting `each of
fiscal years 2004 and 2005'.
