A BILL
To transfer certain lands along the Cle Elum River in the State of
Washington to the administrative jurisdiction of the Secretary of the Interior,
to support a land exchange involving a portion of such lands, and for other
purposes.
Be it enacted by the Senate and House of Representatives of the United States
of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Cle Elum River Corridor Act of 2004'.
SEC. 2. JURISDICTIONAL TRANSFER, CLE ELUM RIVER CORRIDOR, WASHINGTON.
The Secretary of Agriculture shall transfer, without reimbursement, to the administrative
jurisdiction of the Secretary of the Interior certain lands and interests in
lands, previously transferred to the Secretary of Agriculture pursuant to section
7(c) of Public Law 89-72 (16 U.S.C. 460l-18), that are located in sections 10
and 11 of township 20 north, range 14 east, Willamette meridian, and generally
depicted on a map entitled `Cle Elum River Corridor Boundary Adjustment, Sheet
1' and dated March 21, 2004.
SEC. 3. LAND EXCHANGE, CLE ELUM RIVER CORRIDOR, WASHINGTON.
(a) Acceptance of Private Lands- Subject to subsection (d), if MountainStar
Resort Development, LLC, offers to the Secretary of the Interior, within 90
days after the date of the enactment of this Act, a parcel of land consisting
of approximately 38 acres located in section 11 of township 20 north, range
14 east, Willamette meridian, and generally depicted on a map entitled `Cle
Elum River Corridor Boundary Adjustment, Sheet 2' and dated March 21, 2004,
the Secretary shall accept the parcel. The Secretary of the Interior shall have
jurisdiction over the parcel accepted under this subsection.
(b) Conveyance of Lands in Exchange- Upon acceptance of title by the Secretary
of the Interior to the parcel of lands described in subsection (a), the Secretary
shall convey to MountainStar Resort Development, LLC, all right, title, and
interest of the United States in and to a parcel of land consisting of approximately
38 acres located in sections 10 and 11 of township 20 north, range 14 east,
Willamette meridian, and generally depicted on a map entitled `Cle Elum River
Corridor Boundary Adjustment, Sheet 3' and dated March 21, 2004.
(c) Equal Value Exchange- The exchange under this section shall be consummated
on an equal value basis, except that the Secretary of the Interior and MountainStar
Resort Development, LLC, may agree to equalize the agreed-upon values of the
Federal and non-Federal lands involved in the exchange through the inclusion
of monetary consideration, so long as any adjustment agreed to does not exceed
25 percent of the value of the Federal lands to be conveyed.
(d) Conditions of Conveyance- The exchange under this section shall be subject
to the conditions that--
(1) MountainStar Resort Development, LLC, convey title acceptable to the Secretary
of the Interior; and
(2) there is no hazardous material on the property to be acquired by the United
States, as determined by the Secretary.
