Mr. MCHUGH introduced the following bill; which was referred to the Committee
on Appropriations
A BILL
Making supplemental appropriations for defense and for the reconstruction
of Iraq for the fiscal year ending September 30, 2007, and requiring the
President to submit a request for additional funding after certifying substantial
progress has been made in Iraq in meeting certain performance measures.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled, That the following sums are
appropriated, out of any money in the Treasury not otherwise appropriated,
for the fiscal year ending September 30, 2007, and for other purposes, namely:
TITLE I--DEFENSE-RELATED APPROPRIATIONS
For military functions administered by the Department of Defense, for necessary
expenses to carry out military operations in Iraq, $25,000,000,000, to remain
available until September 30, 2007.
TITLE II--IRAQ RELIEF AND RECONSTRUCTION
For necessary expenses to carry out the purposes of the Foreign Assistance
Act of 1961, for security, relief, rehabilitation, and reconstruction in
Iraq, $25,000,000,000, to remain available until September 30, 2007.
TITLE III--GENERAL PROVISIONS
SEC. 301. Not later than July 1, 2007, the President shall transmit to Congress
a request for such additional appropriations for the remainder of fiscal
year 2007 as the President considers necessary for defense and for the reconstruction
of Iraq.
SEC. 302. It is the sense of Congress that Congress should consider providing
additional appropriations pursuant to any request transmitted by the President
pursuant to section 301 predicated on progress by the Government of Iraq
in achieving the performance measures listed in section 303(b), as described
in the most recent report transmitted by the President under section 303(a).
SEC. 303. (a) Not later than March 1, 2007, and every month thereafter,
the President shall transmit to Congress a report containing--
(1) a description and analysis of the implementation in Iraq of the performance
measures listed in subsection (b); and
(2) a certification that progress is being made on the achievement of
such performance measures.
(b) The performance measures listed in this subsection are the following:
(1) IRAQI FORCES- The appointment of a military commander and two deputy
commanders for Baghdad, the provision of three additional Iraqi Army brigades,
and the provision of additional Iraqi National Police forces for assignment
to Baghdad for the purpose of peacekeeping activities to be carried out
jointly by the United States and the Government of Iraq.
(2) OIL REVENUE SHARING LAW- The passage and implementation of a law to
allow oil revenue to be shared with all citizens of Iraq.
(3) REFORMED DE-BAATHIFICATION PROCESS- The institution of a reformed
de-Baathification process under which members critical to the functioning
of a civil society are allowed to reenter Iraq's political and economic
life.
(4) DISARMAMENT OF MILITIAS- The achievement of the disarmament of militias
in Iraq, including the Badr Brigade and Jaish al Mahdi.
(5) ECONOMIC DEVELOPMENT- The provision of $10,000,000 by the Government
of Iraq for reconstruction, including an effective jobs creation program.
(6) CONSTITUTIONAL REFORM- The implementation of the special process for
amending the Constitution of the Republic of Iraq that is called for by
the provisions of Article 137 of such Constitution.
(c) The report required by subsection (a) shall be transmitted in unclassified
form but may contain a classified annex.
This Act may be cited as the `Supplemental Appropriations Act for Defense
and for the Reconstruction of Iraq, 2007'.
