A BILL
To prohibit Federal officials from paying any Federal funds to any
individual or entity that performs partial-birth abortions.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Partial-Birth Abortion Funding Ban Act of 2003'.
SEC. 2. PROHIBITION AGAINST PAYMENT OF FEDERAL FUNDS TO INDIVIDUALS OR ENTITIES
THAT PERFORM PARTIAL BIRTH ABORTIONS.
(a) PROHIBITION- Consistent with the just compensation clause of the Fifth
Amendment to the Constitution, no Federal official may pay any Federal funds
to any individual or entity that performs partial-birth abortions.
(b) DEFINITION- The term `partial-birth abortion' means an abortion in which--
(1) the person performing the abortion deliberately and intentionally vaginally
delivers a living fetus until, in the case of a head-first presentation,
the entire fetal head is outside the body of the mother, or, in the case
of breech presentation, any part of the fetal trunk past the navel is outside
the body of the mother for the purpose of performing an overt act that the
person knows will kill the partially delivered living fetus; and
(2) performs the overt act, other than completion of delivery, that kills
the partially delivered living fetus.
