on Education and the Workforce
A BILL
To suspend certain amendments made by the No Child Left Behind Act
of 2001 if the Federal Government fails to fully fund such amendments.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Fully Fund the No Child Left Behind Act'.
SEC. 2. SUSPENSION OF NO CHILD LEFT BEHIND ACT OF 2001 IN THE EVENT OF INADEQUATE
FEDERAL FUNDING.
If the Federal Government appropriates any amount less than any specific dollar
amount for a fiscal year in any authorization of appropriations in title I
or title II, respectively, of the Elementary and Secondary Education Act of
1965 (20 U.S.C. 6301 et seq.)--
(1) the provisions of such title, as amended by the No Child Left Behind
Act of 2001 (Public Law 107-110; 115 State. 1425), shall not apply for that
year; and
(2) the equivalent provisions of the Elementary and Secondary Education
Act of 1965 (as determined by the Secretary of Education) shall apply for
that year as in effect on January 7, 2002 (the day before the date of enactment
of the No Child Left Behind Act of 2001).
