Mr. STUPAK introduced the following bill; which was referred to the Committee
on Energy and Commerce, and in addition to the Committees on Ways and Means,
and Education and the Workforce, for a period to be subsequently determined
by the Speaker, in each case for consideration of such provisions as fall
within the jurisdiction of the committee concerned
A BILL
To assure that enrollment in any Medicare prescription drug program
is voluntary.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. ASSURING TOTALLY VOLUNTARY NATURE OF ENROLLMENT IN ANY MEDICARE
PRESCRIPTION DRUG PROGRAM.
Enrollment in a prescription drug plan established under title XVIII of the
Social Security Act shall be totally voluntary and no individual shall be
required to enroll in such a plan as part of any contract with any employer
or under any collective bargaining agreement or otherwise (including any revision
made to any benefit or pension plan or agreement referred to in section 9701
of the Internal Revenue Code of 1986, relating to coal industry health benefits).
