A BILL
To provide incentive funds to States that have in effect a certain
law.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Handgun Registration Act of 2003'.
SEC. 2. GRANT INCENTIVE FOR COMPLIANCE.
(a) GRANT INCENTIVE- Section 506 of title I of the Omnibus Crime Control and
Safe Streets Act of 1968 (42 U.S.C. 3756) is amended by adding at the end
the following:
`(1) IN GENERAL- The funds available under this subpart for a State shall
be increased by 15 percent if a State has in effect throughout the State
a law which requires--
`(A) that each individual to whom a handgun is transferred complete a
handgun registration form that includes, at a minimum--
`(i) information identifying the transferee, including name, address,
date of birth, and State handgun license number, if applicable;
`(ii) information identifying the handgun, including make, model, caliber,
and serial number;
`(iii) information identifying the transferor, including name, address,
and date of birth; and
`(iv) proof of insurance coverage for the transferee's liability to
any person who, while engaged in lawful activity, suffers bodily injury
or death through the misuse of that handgun resulting from the transferee's
negligence;
`(B) that each individual who possesses a handgun complete a handgun registration
form that includes, at a minimum--
`(i) information identifying the individual, including name, address,
date of birth, and State handgun license number, if applicable; and
`(ii) information identifying the handgun, including make, model, caliber,
and serial number; and
`(C) the chief law enforcement officer of the State to furnish information
from handgun registration forms to Federal, State, and local law enforcement
authorities upon request.
`(2) COMPLIANCE- The Attorney General shall issue regulations to ensure
compliance with the requirements of paragraph (1).
`(3) DEFINITIONS- For purposes of paragraph (1), the term--
`(A) `State handgun registration form' means a form prescribed under State
law consistent with this paragraph; and
`(B) `chief law enforcement officer of the State' means the chief, or
equivalent officer, of the State police force, or the designee of that
officer.'.
(b) CONFORMING AMENDMENT- Section 506(a) of title I of the Omnibus Crime Control
and Safe Streets Act of 1968 is amended by striking `subsection (f),' and
inserting `subsections (f) and (g),'.
(c) EFFECTIVE DATE- The amendments made by subsection (a) shall take effect
on the first day of each fiscal year succeeding the first fiscal year beginning
2 years after the date of the enactment of this Act.
